Important: By accessing or using Buzzkart's website, mobile app, or any of our services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our platform.
1 Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Buzzkart — Paybuzz Payments Pvt Ltd ("Buzzkart", "we", "us", "our"), a company registered under the Companies Act, 2013, with its registered office in Mumbai, Maharashtra, India.
By creating an account, placing an order, or simply browsing our platform, you confirm that you are at least 18 years of age (or have parental consent), legally capable of entering into contracts under Indian law, and agree to these Terms and our Privacy Policy.
2 Account Registration & Security
- You must provide accurate, current, and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your password and account credentials.
- You are fully responsible for all activities that occur under your account.
- You must notify us immediately at support@buzzkart.in if you suspect unauthorized access to your account.
- Buzzkart reserves the right to suspend or terminate accounts that violate these Terms, are fraudulent, or are inactive for more than 24 months.
- One person may not maintain more than one account without prior written permission.
3 Orders & Fulfillment
Placing an order on Buzzkart constitutes an offer to purchase the selected product(s) at the listed price. Orders are confirmed only upon receipt of a confirmation email from us.
- Buzzkart reserves the right to refuse, cancel, or limit any order at our discretion, including orders where product availability changes, payment fails, or fraud is suspected.
- In the event of order cancellation after payment, a full refund will be processed within 5–7 business days.
- Delivery timelines are estimates and not guarantees. We are not liable for delays caused by logistics partners, natural events, or circumstances beyond our control.
- Risk of loss and title for items passes to you upon delivery to your specified address.
4 Pricing & Payments
- All prices are listed in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise.
- Prices are subject to change without notice. The price applicable to your order is the price at the time of checkout confirmation.
- Promotional prices and discount codes are subject to their own terms and expiry dates.
- In the event of a pricing error, we reserve the right to cancel the order and issue a full refund.
- We accept UPI, debit/credit cards, net banking, and Cash on Delivery. By providing payment information, you represent that you are authorized to use the payment method.
5 Returns, Exchanges & Refunds
Our return policy is detailed in our FAQ section. Key terms:
- 30-day return window from date of delivery for eligible items.
- Items must be unused, unwashed, in original packaging with all tags intact.
- Certain items (innerwear, swimwear, customized products, items marked "Final Sale") are not eligible for return.
- Refunds are processed to the original payment method within 5–7 business days after we receive and inspect the return.
- Buzzkart reserves the right to reject returns that do not meet our return criteria.
6 Intellectual Property
All content on the Buzzkart platform — including but not limited to logos, text, images, graphics, product descriptions, UI design, software, and brand assets — is the exclusive property of Buzzkart — Paybuzz Payments Pvt Ltd or its licensors and is protected by applicable Indian and international intellectual property laws.
- You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from our platform without prior written consent.
- User-generated content (reviews, photos submitted to us) grants Buzzkart a non-exclusive, royalty-free, perpetual license to use, display, and distribute such content on our platform.
- "Buzzkart" and associated marks are registered trademarks. Unauthorized use is prohibited.
7 Prohibited Uses
You agree not to use our platform to:
- Engage in fraudulent transactions, use stolen payment methods, or place bulk orders for resale without authorization.
- Scrape, crawl, or extract data from our platform using automated tools.
- Post false, defamatory, or misleading product reviews.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Violate any applicable law, including the IT Act, 2000, Consumer Protection Act, 2019, or GST laws.
- Interfere with the proper operation of the platform or our logistics network.
8 Limitation of Liability
To the maximum extent permitted by applicable law, Buzzkart shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.
- Loss of data, profits, or business opportunities.
- Delays or failures in delivery caused by third-party logistics partners.
- Product descriptions or images that may vary slightly from actual products due to photography or display settings.
In any case, our total liability to you shall not exceed the amount paid by you for the specific order giving rise to the claim.
9 Governing Law & Disputes
These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of our platform shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra, India.
For consumer complaints, you may also approach the National Consumer Disputes Redressal Commission (NCDRC) or the appropriate State Consumer Disputes Redressal Commission.
